Terms and conditions
Payment of rent
The first instalment of rent must be paid in PLN when you sign the tenancy agreement. Thereafter, rent is payable by standing order (unless agreed otherwise) to arrive on the due date as stated in the tenancy agreement. This means that the standing order must be set up so that the funds leave your account three days before the rent is due. The full rent must be paid by a single standing order.

Deposit
A deposit equivalent to six weeks’ rent must be paid in cash when you sign the tenancy agreement and is held by landlord for the duration of the tenancy in accordance with the terms of the tenancy agreement.
All deposit deductions must be agreed in writing by both landlord and tenant upon the termination of the tenancy. The tenancy agreement entered into is between the landlord and the tenant and, therefore, the tenant cannot hold To Be Rent liable for any deductions made from the deposit which may fall into dispute.

Subletting
By completing this form you confirm that you intend to enter into a private residential tenancy in your name and that you will not (i) sublet the property; (ii) advertise the property on any print or other media, including (but not limited to) internet-based marketing website, or other social media or messaging website or app; or (iii) take in paying guests or lodgers, without the prior consent of the landlord.

Management of the property
At the start of the tenancy we will advise you who is responsible for managing the property. To Be Rent is not managing the property and we cannot authorise any repairs or maintenance or guarantee the speed at which repairs will be carried out.
You may have to obtain the landlord’s consent before proceeding with a repair. It is your responsibility to provide access for the contractor.

Insurance
It is your responsibility to insure your own belongings throughout the tenancy.

Anti-Money Laundering Regulations
To Be Rent is subject to the Money Laundering Regulations 2017. As a result we will need to obtain and hold evidence confirming your identity, proof of your address and source / destination of funds. We will be unable to proceed with any offer until we are in receipt of this information and have completed a satisfactory AML check.

Consequences of early termination
If you vacate the property prior to the end of the term, you will remain liable to pay rent until the term expires or the property is re-let whichever is earlier. You will also be responsible for any other reasonable costs (e.g. Internet, satellite television contracts, TV licences, cleaning, admin fees etc) incurred from that point until the end of the term. For the avoidance of doubt this clause shall not take effect where you are operating a break clause within your Tenancy Agreement.

INFORMATION CONCERNING THE PROCESSING OF PERSONAL DATA

3. Purposes of data processing and the legal base for data processing:
Your personal data shall be processed by the Administrator in order to perform a contract.
The legal base for the data processing is article 6, section 1, (a)-(b) GDPR, namely, voluntary consent to the processing of data or the necessity of data processing in order to perform the contract.

4. Data retention period:
Your personal data will be kept for a period necessary to complete the contract and the limitation period of claims under this contract.

5. Recipients of data:
Your data may be shared with suppliers who provide us with services related to processing of your personal data, for example IT suppliers. Such entities process personal data confidentially, in compliance with our contractual obligations and related purposes.

6. Rights related to the processing of your personal data:
According to GDPR, you have the following rights:
a. the right to withdrawn consent
b. the right to access your personal data
c. the right to rectification
d. the right to erasure
e. the right to restrict processing
f. the right to object to processing of personal data at any time
g. the right to data portability, i.e. this right allows individuals to obtain their personal data in a structured, commonly used and machine-readable format. You have the right to transfer your personal data individually from one Personal Data Administrator to another, or to request the Administrator to transfer your data directly to another Administrator. However, your data will be transferred as long as it is technically feasible.
The right to data portability applies only to the data processed for contractual purposes, pursuant to the reached agreement or on the base of your consent.

h. the right to withdrawn consent to processing of personal data
You have the right, at any time, to withdrawn your consent to processing of personal data. However, the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. To withdraw your consent, please send us such a statement by mail or by e-mail.
i. the right to lodge a complaint
You have the right to lodge a complaint with a supervisory authority, in particular, Inspector General for Protection of Personal Data, who is responsible for protection of personal data.
